Suit against pelvic mesh manufacturer may move to federal court

When one has surgery performed in Philadelphia, he or she may worry about the risk of the procedure and the recovery period. It is probably safe to say that very rarely does he or she worry about the safety of the device being implanted. However, a growing number of complaints have been filed about the risks associated with a certain type of pelvic repair mesh products.

A woman recently filed a product liability lawsuit against the manufacturers of a pelvic mesh product that she says has caused her acute pain that is permanent since it was surgically placed in January 2010. She is suing for a variety of reasons including gross negligence, breach of warranty, common law fraud and violation of consumer protection laws. She claims that the problems the pelvic mesh has created has led to disability and loss of life’s enjoyment.

Her defense team has stated that her case can be compared to thousands of other pelvic mesh related lawsuits. The suit claims that the particular brand of pelvic mesh that the woman had placed inside her body can lead to a variety of health issues including pelvic floor damage, inflammation, infection and organ perforation.

Although the woman initially filed the lawsuit with the Philadelphia Court of Common Pleas, defense lawyers would like to see the case tried in the federal court in Philadelphia. This is because they say the woman appears to be seeking over $75,000 in damages.

Although no lawsuit can undo the damage that has been done to this woman, hopefully she will be able to move on with her life with the proper compensation for the pain and suffering that she has experienced.
