Personal injury attorney Todd A. Schoenhaus was interviewed during a special podcast program for “The Who’s Who in Phillylabor Show” in Philadelphia, along with immigration attorney Ricky Palladino. The show aired on WWDB 860 AM on July 10. The show covered a range of topics relating to recent immigration news, immigration law, and personal injury lawsuits for workplace accidents involving immigrant or undocumented workers brought against those who caused the accident, such as the owner of a dangerous property, contractor who failed to ensure a safe workplace, and manufacturer of a defective machine or piece of equipment.
Schoenhaus discussed some of the issues that undocumented workers and immigrants face in the workplace, and how Eisenberg, Rothweiler, Winkler, Eisenberg & Jeck, P.C., the law firm in which he recently became a Partner, deals with clients who are in these situations. According to Schoenhaus, immigrants and undocumented workers still have workplace rights. They equally deserve to fight for compensation for their catastrophic injuries sustained from their jobs, separate and apart from any workers’ compensation benefits they may qualify for.
Schoenhaus gave insight into how clients have to deal with problems that other legal workers are not familiar with. Immigrant clients that the firm deals with:
- Often do not speak English or have trouble speaking English
- Do not understand their workplace rights
- Rarely if ever have spoken or dealt with an attorney
- Are used to working at jobs with little to no safety standards
Schoenhaus also discussed how liability insurance companies seek to minimize their risks and payouts by unfairly taking advantage of the worker’s immigrant and/or undocumented status, and how it is important to protect against this from happening.
Another issue that immigrant and undocumented workers face is predatory employers who, in order to save money, allow extremely unsafe working conditions to exist that leave their immigrant or undocumented workers in constant danger, often without providing them with workers’ compensation benefits. However, many of these workers will not speak up about the injustices they face because they are afraid of losing their jobs.
Schoenhaus and the rest of Eisenberg, Rothweiler, Winkler, Eisenberg & Jeck, P.C. handles catastrophic injury cases for immigrant and undocumented workers who are bravely fighting for their workplace rights. Our attorneys relate to each of these clients on a personal level and help them gain the confidence to speak up about any injuries or fatalities that they or their family members have faced.
