Pennsylvania: Worker killed on road repavement project site

Almost everyone knows someone who is a construction worker. These construction workers are typically known for performing manual labor, often around heavy equipment. While these types of jobs can be fulfilling and pay well, there are definitely personal injury risks that come with the work, especially when heavy equipment and machinery is involved. Not only may there be a workers’ compensation claim involved in a construction site accident, but a personal injury lawsuit could stem from the same incident.

Recently, a construction worker was killed in Montgomery Township, Pennsylvania. He died on the site of a road repavement project. The lieutenant for the township’s police department said heavy equipment played a role in this construction worker’s death.

A recent article in The Reporter did not mention the name of the construction worker. His name was being held by police until after his relatives could be notified of what happened.

In general, after hearing of a loved one’s death, it is quite normal for friends and family to have questions.

When heavy equipment is involved in an injury or death, some common questions may center on how well everyone on the site was trained to use the equipment and if the equipment was in proper working order. Quite often there are also safety mechanisms on heavy pieces of equipment and it is important that these mechanisms are not tampered with in any way.

One should also know that after a construction site accident, there may be grounds to file a lawsuit. This can be filed by a construction worker who is injured on the site or by the family of a worker who was killed.

In looking at who should be held responsible, remember the blame may be on a third-party, such as the manufacturer of the equipment or the company responsible for servicing the equipment. General contractors and sub-contractors who are supposed to be handling safety on a site may also end up being held responsible.

Of course though, like any type of legal action, figuring out what happened and who should be held liable can be rather confusing. Especially when mourning the loss of a loved one, filing a lawsuit may seem like the furthest thing from one’s mind. However, this is where an attorney can step in for a family to gather information and analyze the facts to build a case.
