Bayer AG settles lawsuits over dangerous oral contraceptives

When a patient is prescribed a pharmaceutical, the patient trusts the pharmaceutical was properly tested, and thereafter marketed in such a manner that protects the patient’s safety and wellbeing. Unfortunately, this is not always the case. There have been patients in Philadelphia and elsewhere across Pennsylvania that have been seriously injured when they have been prescribed a pharmaceutical that is dangerous, or told to take a pharmaceutical in a manner that is not safe. In such instances where this occurs to the detriment of the patient, there can be recourse available.

It can feel intimidating to take on a huge pharmaceutical company, even when a victim knows that the company produced a drug despite risks the company knew about or should have known about. However, an experienced attorney can be a fierce advocate in a courtroom, and assist the victim of a dangerous drug in seeking justice.

The German pharmaceutical company Bayer AG recently agreed to a settlement to address over 10,000 lawsuits across the United States that alleged the pharmaceutical company failed to warn users of the risks the company should have known about the oral contraceptives, Yasmin and Yaz. Victims report that use of these drugs resulted in either gallbladder injuries, blood clots or both.

The lawsuits stemming from gallbladder injuries were consolidated in courts in Illinois, California, Pennsylvania and New Jersey. Bayer AG has agreed to a $24 million settlement to address these claims. Victims that had to have their gallbladder removed will be awarded $3,000, and those that just suffered an injury to their gallbladder will be awarded $2,000. The company is not admitting liability in this settlement, but has decided that this is the best avenue to avoid any further expenses that litigation would bring about.

A $1 billion settlement has also been reached for the victims of blood clots from these drugs. In many instances, when a victim has been injured by a dangerous pharmaceutical, they feel unsure of what to do. Speaking with an experienced attorney can be invaluable in holding a liable pharmaceutical company or prescribing doctor accountable for medical expenses, lost wages, pain and suffering.
