Stewart J. Eisenberg represented the estate of an 8 year old boy who died tragically after the vehicle he was riding in was stuck by a tractor trailer. The boy was returning home from Atlantic City with his church group when the accident occurred. As a result of the accident the rear lift gate opened and all the occupants were ejected from the vehicle. The young landed in the southbound lanes of the New Jersey turnpike where he was tragically run over and killed by an unknown vehicle. Mr. Eisenberg argued before a jury that the minivan was not crashworthy; the manufacturer did not ensure that the vehicle could offer adequate protection from a collision. The automobile manufacturer knew that in certain scenarios the rear hatch could open due to a design flaw in the latch mechanism. It was also know that the seats would collapse backward and the seatbelts would be unable to keep the occupants in the vehicle. Despite knowing these things, the manufacturer failed to warn drivers or recall the vehicle. Stewart recovered $6.8 million for the family of his client.
