Nancy J. Winkler and Dan Sherry represented the wife of a New Jersey State Trooper who was killed pursuing an armed robber. While navigating through a turn, the state trooper lost control of his vehicle and crashed into a utility pole. The pole crushed the vehicle and the officer, killing him on impact. Our attorneys argued that the car was not crashworthy, and the automobile manufacturer was responsible for the death of the police officer.
Evidence was presented that showed the vehicle frame was not welded properly reducing the strength of the frame by at least half. If the frame had been welded correctly the vehicle would not have been as severely crushed and would have protected the state trooper from the majority of the blow from the utility pole.
